Terms of Use
Sunreach estimates when the sun and shadow reach a place, from terrain data and astronomical calculation. The estimates are a planning aid, not a promise. Do not rely on them for anything where a mistake could hurt you or someone else, and never look directly at the sun.
Who we are
Sunreach is provided by Jaka Azman s.p., Mala Loka 5, 1230 Domžale, Slovenia ("we"). Contact: azman.jaka@gmail.com. These terms apply to the Sunreach app and to the website sunreach.app. By installing or using them you agree to these terms. If you do not agree, please do not use Sunreach.
Apple
You get the app from the App Store, so Apple's standard licensed-application terms also apply. Apple is not a party to these terms. Apple is not responsible for the app, for support or for maintenance, and has no other obligation for it. Apple and its subsidiaries are third-party beneficiaries of the licence in these terms and may enforce it against you.
What Sunreach shows, and its limits
Sunreach combines elevation data, building and tree data where it exists, and standard sun, moon and sky calculations to estimate sun times, shadows, light and weather for a place and a day. The results depend on the quality and resolution of that data (30 m terrain in most places, 2 m laser scans in some areas), on your position and compass, and on things the data cannot see, such as trees, new buildings, snow, cloud and haze. Times can be wrong by minutes or more. The estimates are provided for information and planning only.
Safety
- Never look at the sun directly, with or without the camera, a lens or binoculars.
- Do not use AR or the map while walking, driving, cycling, climbing or flying. Watch where you are going and look at your surroundings.
- Do not use Sunreach as a navigation, safety or emergency tool. Sunset, last light and shade estimates are not a substitute for a map, a weather service, a guide, local advice or your own judgement in the mountains.
- Check the rules where you plan to go, such as access to private land, protected areas and drone regulations. Sunreach does not tell you whether you are allowed to be somewhere.
Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, for your own use. You may not copy, sell, rent or redistribute the app, remove notices from it, or reverse engineer it except where the law allows this despite this term. You may not misuse our servers: no scraping, no automated bulk requests, no attempt to break or overload them, and no resale of the data they serve.
Purchases
Sunreach Pro is sold through the App Store as a monthly or yearly subscription. Apple charges and handles the payment. A subscription renews automatically at the price shown unless you cancel it at least 24 hours before the end of the current period; you manage and cancel it in your Apple Account settings. A free trial, if offered, turns into a paid subscription at its end unless you cancel before. The price, tax, cancellation and refund rules are Apple's and are shown to you in the App Store before you buy. We receive no payment details.
Data from others
Terrain, maps, place names and weather come from third parties, listed on our attributions page and in the app. We do not control them and do not promise they are complete, current or available. Their own licences and terms apply to their data. Weather information comes from Apple Weather. Place names are © OpenStreetMap contributors.
Our rights
The app, its name, logo, design and the processed data we produce belong to us or our licensors. These terms do not give you any ownership of them. The third-party data and open-source software the app uses stay under their own licences. If you send us feedback, we may use it without owing you anything.
Changes and availability
We may update, change, suspend or stop the app, a feature or a data source, for example when a data provider changes its service. We do not promise it is always available or free of errors. We may change these terms; the new version will be in the app and on sunreach.app with a new effective date, and material changes will be noted in the release notes. If you keep using Sunreach after a change, you accept the new terms. If you do not agree, stop using the app and delete it.
Our responsibility
We do our best to make Sunreach accurate and useful, but, as far as the law allows, we provide it "as is" and do not promise that its estimates are correct. As far as the law allows, we are not liable for losses that come from relying on the estimates, such as a wasted trip, a missed photograph or a changed plan, or for indirect or consequential losses.
Nothing in these terms limits liability that the law does not allow us to limit. That includes liability for intent or gross negligence, for death or personal injury caused by our fault, and the rights you have as a consumer under mandatory law, for example if digital content does not conform to the contract. Where you are a consumer, the limits above apply only to the extent mandatory consumer law allows.
Ending
You can stop using Sunreach at any time by deleting the app. We may suspend or end your access if you break these terms or misuse our services. The parts of these terms that by their nature should continue, such as those on our rights and our responsibility, continue after that.
Law and disputes
Slovenian law applies to these terms. If you are a consumer in the European Union, you also keep the protection of the mandatory consumer rules of the country where you live, and you may bring a claim in the courts of that country. Otherwise the competent courts in Slovenia decide disputes. If you have a problem, please write to us first at azman.jaka@gmail.com; most questions can be solved quickly.
